{"id":3639,"date":"2019-07-28T22:25:04","date_gmt":"2019-07-28T22:25:04","guid":{"rendered":"https:\/\/www.ua-cpas.com\/blog\/?p=3639"},"modified":"2019-07-28T22:25:04","modified_gmt":"2019-07-28T22:25:04","slug":"dol-audits-checking-for-overtime-can-cost-companies-big-time","status":"publish","type":"post","link":"https:\/\/www.ua-cpas.com\/blog\/index.php\/2019\/07\/28\/dol-audits-checking-for-overtime-can-cost-companies-big-time\/","title":{"rendered":"Stiffing on Employee Overtime can Cost Companies Big Time!"},"content":{"rendered":"<p>The State and US Dept. of Labor (DOL)are increasingly paying attention to wage-and-hour calculations and thus launching more wage and hour exams.<strong>\u00a0<img loading=\"lazy\" decoding=\"async\" class=\"alignright size-full wp-image-3642\" src=\"https:\/\/www.ua-cpas.com\/blog\/wp-content\/uploads\/2019\/07\/landscaper-pruning.jpg\" alt=\"\" width=\"275\" height=\"183\" \/><\/strong><\/p>\n<p><span style=\"color: #800080;\"><strong>The Plot <\/strong><\/span>Unintentionally or otherwise, a NJ landscaper cut some corners, and recently got raked over by the DOL. Fullerton Grounds Maintenance, a Kenvil-based landscaping service, failed to pay more than $500,000 in OT to its employees, per the NJ Dept. of Labor &amp; Workforce Development\u2019s\u00a0 Division of Wage &amp; Hour Compliance.<\/p>\n<p><span style=\"color: #800080;\"><strong>The DOL Harvest<\/strong><\/span> A 6-month investigation revealed that workers had not been paid $529,898, collectively, in OT for time worked over 40 hours a week. The employer cooperated with the investigation, according to the State, \u201cand agreed to perform a self-audit to calculate the amounts owed to the 362 employees who were paid improperly.\u201d<\/p>\n<p>The NJ DOL investigation also determined that the landscaping company took illegal deductions for uniforms and other items not permitted by the NJ Wage Payment Law.<strong>\u00a0<\/strong><\/p>\n<p><span style=\"color: #800080;\"><strong>Another DOL Shopping Spree <\/strong><\/span>An employee-generated 2019 NJ DOL audit recovered $133,490 for nine underpaid supermarket workers. A US DOL exam of R&amp;J Supermarket Corp. in Jersey City, revealed OT, minimum wage and recordkeeping violations. For deficient employee records, the employer paid $49,349 in penalties.<\/p>\n<p><span style=\"color: #800080;\"><strong>A Growing Concern<\/strong><\/span> The pace of wage-hour investigations \u2014 many of which are triggered by employee complaints, is on the rise. In 2018, the US DOL\u2019s Wage and Hour Division (WHD) recovered $304 million in back wages. As these NJ audits reflect, once an agency begins to investigate your firm, there\u2019s no telling what it\u2019ll turn up.<\/p>\n<p><strong>\u00a0<\/strong><span style=\"color: #800080;\"><strong>More Concern <\/strong><\/span>US and State agencies aren\u2019t the only ones chasing after companies.<\/p>\n<p>Employers will confront more wage-hour class action suits as more plaintiff-lawyers take up the charge. There\u2019s been \u201can on-going migration of skilled plaintiffs\u2019 class action lawyers into the wage and hour litigation space for close to a decade,\u201d according to the <em>Annual Workplace Class Action Report<\/em> \u00a0by the Chicago law firm Seyfarth Shaw LLP,<\/p>\n<p><strong><span style=\"color: #800080;\">An Ounce of Prevention<\/span>\u2026<\/strong> firms should keep up with the latest developments in State and US wage and hour regulations.
